Terms & Conditions

Definitions
  • The Competition: The process by which the opportunity to win Prizes will be marketed, entries obtained and winners selected by the Promoter, as defined in these terms and conditions.
  • Entrant: Anyone who answers the competition questions and successfully pays the Entry Fee.
  • Entry Fee: £25 per entry.
  • Winner: One of 105 entrants chosen at random from those Entrants who answer the Competition questions correctly.
  • Closing Date: the Competition will close (1) at 10:00pm GMT on 31st May 2009 (2) when 45,000 Entry Fees have been collected or (3) if an event occurs that is outside the reasonable control of the Promoter, whichever occurs first.
  • The Property: A detached house with swimming pool plus hot tub/spa built on a 5 acre parcel of land with the address of 100 North Goodman Road, Kissimmee, Florida 34747, USA.  
  • The Package comprises the Property plus the following:
  • Furniture – The Property will be fully furnished to a level that makes it ready to occupy and this will include appliances, TVs, bed linens, towels, crockery, cutlery, pictures, plants and ornaments.
  • A Car – a new Family size, Chevrolet Malibu, Toyota RAV 4 (or equivalent to approximately the same price).
  • Golf Package – Gift Certificates which allow up to 40 rounds of golf at courses located within a 20 mile radius of the Property (Note: these will be subject to individual golf course terms and conditions).
  • Disney Tickets – The choice between an annual premium pass or a 10 day no-expiration premium pass for a family of 4 (subject to Disney terms and conditions).
  • Day Spa – The choice of a 1 year Family of 4 membership to the Celebration Fitness Centre and Day Spa (approximately 10 miles from the Property) or the equivalent value in gift certificates with no expiration date (subject to Celebration Fitness Centre and Day Spa terms and conditions).
  • Property running costs and management expenses for the first year after the Winner is awarded the property.
  • Other Prizes: A total of 104 cash amounts defined in ’The Prizes’ below.
  • Owners: Colin and Sue Stafford, who have granted Power of Attorney to the Promoter giving him authority to use the Property in the Competition.

  • Running costs: Property taxes and insurance, Homeowners Association fees, a Utilities Allowance and routine maintenance of the Property, the lawn and the pool.  (Note: routine maintenance excludes normal wear and tear and damage due to accident or misuse of the Property or its facilities).
  • Property Management: the duties of maintaining the Property, overseeing service providers and supplying regular reports to the Winner of the Property.
  • Utilities Allowance: $500 per month to cover electricity, phone, internet and satellite television service.

Entering The Competition
The Competition is operated by the Promoter.  Competition entry will initially be online only from 16th November 2008.  A maximum amount of 45,000 Competition entries will be permitted.  Entrants will access the web site, navigate to the Enter Competition page and answer the required skill-/knowledge-based questions.  They will click through to another page to enter personal details including a valid e-mail address and confirm their acceptance of these terms and conditions, and finally click through to Allied Wallet, the credit card processing company, to finalise payment of the Entry Fee using a credit card.  Allied Wallet will confirm successful payment receipt.  If Allied Wallet does not confirm successful payment, then the Entrant is not included into the competition.  

Additional key aspects of entering the Competition are:
  1. Entry into the Competition is open to all persons aged 18 or over, other than the Promoter, the Owners and their family and anyone connected with administration of the Competition or ownership or operation of the Web site.
  2. There is no limit to the number of entries that can be made by any one Entrant.
  3. Each Entrant is responsible for the supply of their personal details including a valid e-mail address – confirmation of a valid entry into the Competition will be automatically sent (by Allied Wallet) to the e-mail address supplied by the Entrant and the Promoter will not be responsible for any loss due to the failure to supply valid information.
  4. All Entrants understand that only fully completed entries will be entered into the Competition.
  5. All entries into the Competition are final.  No refunds will be made unless the competition is cancelled for any reason.
  6. The Promoter reserves the right to establish shopping mall and other retail promotion locations to promote entry into the Competition.  If this occurs, details of where and when these locations are to operate will be published on the Web site.

The Prizes
  • 1st Prize – the Package. All property conveyancing costs and fees of the Owners and the Prize Winners will be paid by the Promoter.  The property will be transferred “free and clear” of any mortgages, loans and other charges.  Once the property transfer formalities have been completed as required by Florida law (a process that may take several weeks after the close of the competition) ownership will be on a “Fee Simple” basis, similar to the UK Freehold type of ownership.  A Florida state-regulated Title Company or a Florida attorney will handle the transfer of ownership to ensure that all required legal formalities are complied with.  A cash alternative of £200,000 will be available to the 1st Prize Winner if he/she chooses that option instead of the Package as described in Notifying the Winners below.
  • One 2nd prize of £10,000.
  • One 3rd prize of £5,000.
  • 4th and 5th prizes: £2,000 each.
  • Final 100 prizes: £100.

Selecting The Winners
Winners will be selected within 14 days of the closing of the Competition in a random drawing organised by the Promoter from all of the correct entries.  The date of the drawing and the correct answers to the questions will be published on the website within 48 hours of the Closing Date. 

The Promoter will arrange for independent observation of the drawing, including a representative from a firm of accountants and other invited guests.


Notifying the Winners
Notification to the 1st Prize Winner will be by e-mail and by phone with a request for a copy of his/her driving licence or passport (to confirm personal details) plus a request to select the Property or the cash option defined in The Prizes above.   Unless the Winner responds to this request within 7 days, his/her name will be discarded and a new name drawn as the designated 1st Prize Winner.

Other prize winners will be contacted by e-mail for confirmation of address details.  Cheques will be mailed to these Winners within 21 days of receipt of address confirmation. 

The name and town of the Winners (not their address) will be published on the Web site within 48 hours of the 1st Prize Winner confirming personal details as described above.


Distribution of Funds
Entry Fees will be retained in a separate bank account established solely for the purpose of the Competition until distribution of the Prizes is authorized by the Promoter.  If the level of entries does not reach the maximum of 45,000 by the Closing Date, the Prizes set out above will not be awarded.  Instead, a deduction of 35% from the total Entry Fees collected will first be made to cover administrative, legal and marketing expenses, after which the balance will be allocated as follows:
  • 85% to the 1st Prize Winner.
  • 5% shared between the next two Prize Winners.
  • 5% shared between the next five Prize Winners.
  • The balance shared between 100 Winners.
If less than £1,000 is available for distribution, for whatever reason, the whole amount will be donated to a Charity nominated by the Promoter.


Privacy Policy
Entrants understand that the Promoter will enter their personal details into a database and will use that information in accordance with the provisions of the Data Protection Act 1998 and this Privacy Policy and entry into the Competition represents authorisation to do so.
 
Entrants also understand that the Promoter may use contact details and other data including personal data as defined by the Data Protection Act 1998 and supplied by Entrants to administer the Web site and conduct the Competition according to these Terms and Conditions. All personal information collected will be used solely for administration of the Competition and the Promoter will not share, sell or otherwise distribute personal information collected. 

However, Entrants understand that the Promoter may disclose information to relevant third parties for legal or regulatory reasons, including but not limited to money laundering or the prevention of fraud.


General Terms & Conditions
  • By entering the Competition, all Entrants agree to be fully and unconditionally bound by these Terms and Conditions.  
  • Only entries made using the English language will be valid.
  • Only Entrants aged 18 and above are eligible to enter this competition.
  • By entering this Competition, Entrants certify that they are not contravening any laws of their country of residence and the Promoter will not be liable in any way if an Entrant enters the Competition unlawfully. 
  • In particular, to meet USA legal restrictions, the Promoter is unable to accept entries from USA residents.
  • Entrants understand that winning a Prize in this competition calls for the exercise of skill, judgement and knowledge.  The Competition is a Prize Competition for the purposes of Section 14 (5) of the Gambling Act 2005.  Prizes are not allocated wholly by chance.
  • The Competition and all associated activities are governed by English Law and in the event of any dispute arising out of the Competition, the Courts of England shall have exclusive jurisdiction.
  • The Promoter accepts responsibility for USA tax liabilities arising on the transfer of the Property to the Winner.  Entrants are responsible for personal taxes charged by their home country tax authorities, if any are applicable.  
  • Entrants warrant that all information that they submit is accurate, true, current and complete. The Promoter reserves the right to disqualify any entrant (entirely at his own discretion) if there are reasonable grounds to believe the Entrant has acted in breach of any of these Terms and Conditions or if the Entrant has engaged in any fraudulent or dishonest activity.
  • Entries will become the property of the Promoters on receipt and will not be returned.
  • It is the sole responsibility of each Entrant to retain a copy of the confirmatory e-mail referred to above for their future reference and to request such a confirmation if this is not received within three days of submitting a Competition entry.
  • The Promoter does not warrant that access to the Web site shall be constant or error free.
  • The Promoter’s decision is final.  No correspondence will be entered into about the results of the competition.
